Is it possible to upgrade from a CS3 "Student version" to a CS4 commercial version of Design Premium?

Inappropriate?I'm not quite sure, but why do you want to? The products are completely identical. It's only the sku and price that are different. Are you looking to upgrade from a student copy of CS3 to a retail copy of CS4?

Yes, from Student CS3 to retail CS4.

Inappropriate?Hmmm... Good question. I tried to find some documentation on this topic internally, but couldn't. There are various flavors of our educational SKUs. We have site licenses for K-12 and higher eduction where the educational institutions hold the licenses. Then we have skus for compasses who act as resellers, under which the student holds the license.
Do you have a copy of the EULA that came with yours?

This notes a couple of exceptions for Educational licenses. The most significant that I found was that you cannot transfer your Educational license to another user, as you can with a standard version with a bit of paperwork.
There's nothing I found in this EULA to indicate that you cannot use the product to make profit. Keep in mind, this is not the same EULA as would apply if the license is owned by the school as part of a volume licensing deal.

Inappropriate?I'm not sure if it is possible, however I think I can confirm that student products can't be used commercially as adobe stated "Student edition products may not be used for commercial gain or resold" on a note that came with my flash cs4 student.

Inappropriate?Review the EULA as described above. And, again, this assumes you are the owner of the license. It might be different if you are using a license owned by the school.

I'm sorry to hear about this limitation for outside of North America. My guess is that this is due to the complexity of so many laws for different countries. I can't advise you on questions of legality, but I would expect that work that doesn't create income would not be considered "commercial". -

We share the same private computer and we're hoping to use the same software. Can you verify if he's permitted to use it for commercial purposes as well?

Inappropriate?I do some work with Adobe on the Student Editions of Creative Suite 4 - I can confirm that the Creative Suite 4 Student Editions license does in fact allow you to create commercial content, within North America only. The Student Editions come with a discount of up to 80% off the commercial price.
I also suggest checking out http://studenteditions.adobe.com - they have FAQs and content there that can answer any questions you have about the Student Editions. -

Just received this from the Adobe live chat service "Adobe: I'm glad to inform you that from education version of Adobe Creative Suite 3 Master Collection, you can upgrade to commercial version of Adobe Creative Suite 4 Master Collection."
