Why can Comcast restrict speeds on certain types of downloads?

I can download from websites at a very high speed. I mean speedtest.net allows me to hit 30mb/s since I just recently called and told them this problem, and they bumped me up to the highest rated service to test this for a week.

When I use torrent software and download legal software I am capped at 1.4 mb/s I have tried this at many different houses in my city, and no matter how many good connections I have to download from their is no way I can download faster than that. Isn't it illegal to manage your network to do so from the FTC?

It just seems I'm paying for max download speeds, and that I should be able to obtain these speeds under any protocol. I really feel comcast customers should do a class action law suit because of this. They are advertising speeds that are only available with http downloads, and are not able to restrict their network like this...
