EFF needs a Glossary of Terms! Last reply on October 18, 2007 21:06.
The EFF web site should really have a glossary of terms explaining the various words and issues related to the work they do -- like Fair Use, Notice & Takedown, CDA, DMCA, Subpeonas, Copyright, Trademark, Cease and Desist, Record retention, etc. -

Interesting case of the EFF vs. Landmark Education Last reply on October 18, 2007 14:53.
I just learned that the EFF took on Landmark to stop them from mis-using the DMCA [http://www.eff.org/cases/landmark-and...]. Having sat through Landmark's recruiting pitch I know that they consider their "ideas" as "core technology." In this case they are trying to equate the discussion of the ideas with the specific embodiment of them in the training manual. They're obviously not the same thing, as any IP lawyer can tell you.
Landmark is the descendant of est (erhardt seminar training), the famed human potential seminars of the seventies. Whenever you ask someone from Landmark about what the connection is with est they'll say "we just purchased technology from them." The "technology" is the ideas behind the training, I guess. Given their belief in the proprietary nature of their ideas, it makes sense they'd attempt to shut down films that capture them for public viewing. Particularly on the Internet! -

AT&T to start "policing" its network Last reply on June 15, 2007 18:29.
It seems as if they're nostalgic for the AOL walled garden model of Internet services:
AT&T is going to start policing its network to prevent the distribution of materials it considers to violate copyright. (Um, Fair Use?) It's doing this so it can strike special deals with content companies to offer their products exclusively.

An open source, peer review approach to patent reform Last reply on June 14, 2007 19:44.
This could prove to be very interesting:
The Peer to Patent Project is an initiative that opens the patent examination process to public participation. An online community-based effort, the Peer to Patent Project aims to improve the quality of issued patents by enabling the public to supply the USPTO with information relevant to assessing the claims of pending patent applications.

What's the difference between the EFF and the ACLU?
They both seem to focus on free speech rights. I get that the EFF is focused more on how these rights apply to technology, but why doesn't the ACLU do this kind of advocacy as a part of their work? What projects do the EFF do that the ACLU wouldn't? -

The Open Rights Group looks like the UK version of the EFF Last reply on June 12, 2007 17:14.
They're younger (2 years old) and are lot less developed, but they seem to share the same mission. Their wiki describes them like this:
"The Open Rights Group is a fast-growing NGO focused on raising awareness of issues such as privacy, identity, data protection, access to knowledge and copyright reform."
I wonder if they have any kind of relationship with the EFF. -

I've heard something about a section of the DMCA that might allow that. -

What is the best way to protect yourself from patent infingement claims besides getting a software patent? Last reply on June 12, 2007 06:21.
Most times when people are talking about software patents, they are always saying you should get them for defensive purposes. Unless the company is evil (jk). I particularly don't like that because it feels like you are giving up and going along with something you normally wouldn't do but feel forced.
I'm wondering what the best way to protect yourself from reprisal would be *besides* going along with the system. Could you, for example, get everything for a patent worked up (as in, the full application) and then put the application into the public domain?
Obviously, that doesn't work if you want to keep the tech proprietary. What about the old mail-hack, sending yourself a registered letter containing the document.
It seems like you would still be at risk for a lawsuit since the validity of the document isn't stamped with the USPTOs approval, but would the above methods help in any quantifiable way? Would they help to prove prior art and dismiss any claims? -

What's wrong with patents, exactly? Last reply on June 12, 2007 06:16.
I see that the EFF has a "Patent Busting" program, but it's all overwhelming to me.
Can somebody explain in a few simple bullet points what's wrong with the current US patent system, and why technology companies should or shouldn't invest the time, money, and resources into filing for them?
Something I could use in an argument with the co-founders of my current startup company would be ideal -- I really don't want to put the time and effort into patents if there's no value in doing so. -
