Class action lawsuit against facebook for disabled accounts?
I am an attorney in Chicago and am considering filing a Class Action lawsuit against facebook. My account also was disabled with no explanation.

i have had my account disabled, thats fine, my problem with it is, how am i supposed to know how much, is too much, all im doing is interacting with friends, but yet im told this is wrong, and all facebook say is, we cant tell you or show you the content of why you were banned, well, why not, even criminals have a voice, but not facebook users, that isnt fair, or just x -

900 people sign up under new accounts some accounts are disabled some merely suspended but the old members still sign in as someone new.
this could be used this to grossly inflate the no of users and would bump the value of the company. most of face book's audience isnt real many are duplicates i would supose the advertisers and share holders,might feel a little defrauded by this because that is effectivlly what is happening

Inappropriate?Tony K, did you ever get reinstated or have you moved forward with a class action suite? I think there is still a huge opportunity for an attorney to make a name for themselves by taking Facebook to task over this issue (perhaps under the guise of unfair or discriminatory business practices, information privacy issues around their collection of credit card information in Profiles, etc.) Even if there is little chance of material gain/penalty the publicity alone should surely be enough to entice an attorney somewhere to take up the cause. The intention wouldn't be to shut Facebook down - just convince them to act like a responsible corporate citizen towards their customers.

Inappropriate?Had my account for about 8 weeks, added 489 friends due to another application, got the email warning and stopped cold....5 days later.....kaboom, no warning account disabled. No response from my tow emails, spent some money on one of their partners products and now can not access it. I requested a refund, and have yet to hear from anyone. You betchya I would join in this class action suit, saw your post on consumer complaints with hundreds more...still trolling the internet and finding hundreds more....looks like to end to this.

They did the same to me today, I sent them a letter bitching them out, my account is under investigation, they can wipe their ass on that electronic email as far as I'm concerned. PINKING people, insinuating that you are spamming more bullshit! Every page, every game encourages you to add people, then they penalize you for it. WTF is that about? Sounds contradictary to say the least. File a class action suit, I"ll be right there bitching the loudest here in Ohio!! All that and one of their rules is no sexual offenders. WKYC tv found 3 within the past month. Seems like Facebook is in violation to me!! -

Inappropriate?Class action suit is a start at least. Seems to me a lot of the games have joined them in their fraudulent activities. If you invest money in their little scams, you will have your account disabled, just a warning. However, if you do not send them your hard-earned money, they disable your account "because Facebook flagged your account as a POSSIBLE duplicate account. Maybe add these applications to the class action suit?

It's also the best way for me to stay in touch with my 18 yr. old granddaughter, who is getting ready for college. I haven't broken any rules - it's very upsetting. Donna... I am in the same boat as you! I have been disabled and really am clueless as to the reason?!? FB actually sent me a letter citing "Sexually explicit and Sexual Harassment!" as reasons!!! Um, if photo's of your family and friends at church and family functions, pictures of a new re-engagement-for-remarriage-after-35-years ring, and photo's of Harper's Ferry and other trips are Sexually explicit then I am really confused! I really am mortified. People at church keep asking me why my account is not showing? I am feeling like this is sort of a defamation of my character, and certainly there must be some recourse? I am really upset, too! -

Inappropriate?I think I might know who he is. I know a very outspoken person on FB that still has his acct, and it might be him. This page seemed like a place to get help but it is in fact like hundreds of other pages on the web...a place to divert us from FB addresses. I have more time and money when I don't play Zynga games and if I need to I can restart a new account under a new email for corresponence with my real friends. I'll let Zynga, FB and the people that advertise there (that I am boycotting) take the hit in a bad economy. They bit off more than they can chew. They can't tell you how many friends or messages are too many or what you did wrong, but MySpace can. I am IT certified in a few areas and it was obviously bad planning on the part of the kids that run FB. I think FB blocks my mail to the disabled@ address now. They can't handle their own network.

Again, You have "disabled" my page(s)— I am assuming that since I can not access my personal page you have also disable the company page (Fine Piano Services-also note we may be paying for ads!), as well?
Truly again I am stymied! AND I am frustrated beyond belief that I am never told why I am disabled— Our latest news posted was—June 3rd—that of my husband of 35 years, asking me to Re-marry him again. I posted photos of the rings, and talked to friends and family through my page... now "poof" my page is gone, again!
Let's see, I also played WordTwist, and PathWords, challenging my daughter Summer, my closest friend... Added some friends from Sparta High School in NJ, and was searching for some HS mates from my Dad's HS in Hackensack, NJ!
Really... Not one thing that could be taken as a slight, or misdeed against anyone! I am truly hurt and offended by this latest—what I am seeing as an assault against my character.
As I stroll through FB pages, I often notice content that I am personally uncomfortable with, and I chose to disassociate myself with those persons... Yet I post simple, plain posts of a 'G' rating, and am "disabled?"
There truly has to be some quick and logical way to repair this permanently?

I sincerely do hope that you do in fact have proof of this charge.
I have never posted ANYTHING, ANYWHERE on Facebook, of a sexual, nude or explicit nature! I don't even think I've posted a "nude" baby photo! Certainly, I have never sent or posted anything even remotely sexually suggestive or harassing period.
I have just left a message with our attorney, S.Oser...
Most of my posts and images were of family and our church group, as well as a few ancient older photos from the 40s-60s of my family in younger and healthier times. As I have said in several of my posts: LGS or Life Gets Snarky... or to say that even when one thinks all is going along well, something will happen to show you that all is not what it appears to be!
I suspect that FB tags a person for some reason, and for time immemorial, not matter what they do, FB will find a way to give you them proverbial shaft. There is obviously a problem somewhere in your system, and I find it sad. To that pointI feel that FBs not even being willing to bring forth the 'evidence' against someone, only proves this end.
I used FB to locate and reconnect with friends from the many places I lived during healthier years, in my childhood, I am very sad that for some reason, I am being falsely accused and singled out for something of such an offensive nature, more so, something I really did not do!
Please, don't patronize me... as frankly, no, I do not understand...

Eli was the only one who actually replied to a message a week ago, but that was followed up by a canned message. I can't afford a lawyer or I'd have one. My friends and I have asked for me to be re-enabled several times, yet no answer and no proof of my offense. I have spent several hours and days and spent money on games I can no longer play. I too have seen x-rated material on the gift sites and have found it to be pretty inappropriate considering some of the age groups that use FB. But you do realize that Tony K probably works for FB, has his acct back, or doesn't really exist, and this is a place to divert us from the actual FB contacts. What I'm understanding as a network administrator is that we are doing exactly what they prod us to do (add friends and play games), but they can no longer handle the server load due to the explosion of new accounts - or - want us to start a new account with our old one on hold so that their advertisers think they have a bigger audience than they do. If there is a Tony K, I think I know who he is. But that's no help as I cannot contact him. I suggest a loud boycott of everyone who advertises on FB due to the mistreatment of it's users and the x-rated material in the gifts section. -

Inappropriate?Tim... I completely understand your obvious frustration, as I share in the pool of problems. However, in the end it really doesn't matter whether Tony K is real or fictional, whether he is prepared to move forward or is happy with the outcome he received. The fact is that the more attention these problems with FB's disabling practices receive, the more likely someone—like a qualified attorney looking for a cause that MIGHT make a difference and aid their career— will take notice.
My concern with FB is that they are making allegations that are in many cases, untrue. And then using those false allegations as the basis for disabling accounts. They are able to make charges and accusations against their users, without producing proof of those charges. That is akin to a policeman driving up to your door, knocking and saying, You are under arrest and hauling you off to jail, without ever reading you your rights or telling you what the charges are. You are not given any rights within the FB framework as it stands today. The current FB philosophy seems to be that, You are guilty until proven innocent, and even then, if we decide your guilty, you are.
I have been "accused" by Eli, of FB as quoted:

Yet I have never posted or sent "messages that are sexually suggestive, or that other users may find harassing in nature." And so, I am searching for attorneys that might be willing to take on the cause. False accusations of such may not be as acceptable legally, and I have been falsely accused. Even IF they are willing to reinstate my account, I am prepared to move forward.

Inappropriate?They are getting away with robbery! I spent money on godfather points in the game mafia wars and now I have been disabled for 22 days with no response to emails or phone calls. I was disabled for adding friends from a mafia wars add-on page where the people had their links posted to be added. This and many other pages are constantly promoted on the main wall and the game itself constantly tells you to add more mafia to become stronger. How can they punish you for something that they promote?? There are many of us that this has happened to and I want to know how they can steal my money with no explanation!!!

Inappropriate?I have received 5 warnings since last fall and last fall was disabled for adding to fast. Facebook told me outright the last time a couple months ago that they dont want members making new friends and that they are to restrict their friends lists to people they know personally. they also said several times that for security reasons they cant tell the limits for adding but that there are no specific limits and its upto the admin that sees the adding weather on not to disable or delete an account.

Inappropriate?I've been trying to get my account back since June 2nd I even sent a complaint through the Better Business Bureau but besides the automatically generated emails no one seems to bother giving me a straight answer. My only fault was sending too many F/R's but it was to play the Playfish games and I was not harassing anyone. Shane please tell me how you got your account back!

Um... I doubt that you will ever hear from Tony... This is an OLD post, and I suspect, as do many others, that he has either re-gained his account or dropped off the face of the earth.
I have NEVER received a Warning from FB, one minute I am there and the next... gone.
The last time I was disabled, FB told me that it was due to posting "sexually explicit material," which is out and out, UNTRUE. They deleted my account, and the second account I set up a week or so after being deleted, as well. I am in the process of trying to get set up with an attorney, as since being deleted, I have been harassed by some person who I suspect may have been the one to have me disabled. So, I forwarded his/her email onto the attorney as well. We shall see how it goes. It's all kind of crazy. FB doesn't have to follow any of the normal "laws of the land." With FB, "You ARE Guilty until they decide you are Innocent." Add to that that they feel they are not obligated to in anyway back up their claims against you. I suspect that this may really be unconstitutional, but it takes money to fight them, or an attorney willing to go out and fight for a cause. And since most attorney's would prefer money, well... therein lies the rub.

I suspected that someone reported ME as well, but this is not the case. My initial profile was open to "friends of friends" and I was certain that someone from a previous relationship was behind it. Now, I think it is 100% FB. I just created a new profile, (PRIVATE) and not even 24 hours later it was gone! Just like that. You cant report what you cant see!
NOTHING OFFENSIVE.......nothing much, PERIOD! I DID however, post a link to THIS THREAD! I wonder if FB has taken on the role of Big Brother.....? Since there is NOTHING offensive on my account, but there is something "slanderous" towards FB on my account, this could be considered a breech of Constitutional Freedom of Speech......I have the right to post what I want, as long as it's within the TOU, and railing on FB is not listed.....ha ha ha.

Well Swoop... IF you can garner some attorney into action, I assure you, I will be more than willing to jump on board! I had my original account for nearly 3 years and did little with it... Then a year ago, another FB member began causing me real problems, which I basically tried to ignore after being bounced from FB the first time. After that, I walked on eggshells, and still within 2 weeks was bounced again! Got them to re-admit me, and I don't think I was on 3 days before I was off again... This went on a couple of times, until they let me back on and I locked down the account to ONLY friends! The problem is/was that still somehow, she was able to find me, and this last time, FB bounced me they decided it was permanent! Still they can't/won't show me what it is I am supposed to have posted.
Don't get me started on FB's TOU... Sadly I find it akin to "Hitler's Final Solution..." They are just eradicating those they don't choose to deal with. It's clearly their way or no way.
Ah well... Keep me posted. -

Frances... I've read through your entire post. Bonne chance with regard to being re-instated. As I have said several times before, I never even received a warning! All that I know is that I have been disabled, permanently, period... AND I must add, for reasons that could easily—were an attorney or other sane person, able to access my page— be proven to be absolutely false! In fact, their claims could easily be construed as harassment and defamation of character!

My account is currently active, but I've been receiving warnings for the past three days. I limit my commenting to only 5 to 10 per day (over an 18-hour period, not all at once), but I think the warnings will continue to appear unless I stop commenting entirely for two or three days. The aspect that causes mental anguish is that they don't tell you how long you have to stop. They don't tell you anything, and that's what makes the whole experience a Kafkaesque nightmare for all of us. -
Inappropriate?Frances unfortunately my account was disabled because I ignored the various warnings received, I was sending too many F/R's that FB considered harrassment. Though the people I was adding were all listed in a forum for the playfish game Restaurant City, so I was only adding people who wanted to be added, FB considered my actions to be against their terms of use. I don't understand why they allow certain applications to be on their platform if to use them one is in danger of having their account disabled. It's been 2 months already and it's very frustrating.

I'm sorry, Antonietta. I feel for you. Your experience was much worse than mine, but I do have a friend whose account has been permanently disabled. -
There are a lot of us who's accounts have been 'permanently disabled.' The sad thing is that many of us don't really even know why!
FB will tell us that we have been disabled for some ambiguous reason or another, and more often than not, their charges do not hold water, FB would have a difficult time making some of their claims and assertions stand up in court. FB goes so far as to say that they are not beholden to anyone, that they do not have to prove their allegations against anyone. IF they decide someone is 'acting' against what they have determined to be their ToU, then 'poof' you are gone, with no recourse.
The whole thing seems not just unfair, but somehow "legally wrong." -
Inappropriate?I know what you mean fulload, I hear of people getting their accounts back everyday, yet some of us have been singled out and banned forever for reasons that only FB knows. Since both my daughters have accounts I see so many fake accounts with strange names, people who have 2 accounts, the photo is the same, they use different names; and the list could go on. Do they get disabled? No, it would take years to uncover all the fake accounts but why bother, what do they care!

I totally agree with you! How about the dual accounts? Like "DavidandSuzie" or "Jimmy Sue Jones?" IF I did that, I'd be bounced off in a heartbeat! It's crazy. I suspect what happens is that somehow, some of us get singled out by the FB control Bots, and then, from that point forward we are destined to eradication. It's the bots against the breathers and in that situation, due to poor programing, the bots always win. -

Of course the only people who took the time to answer me are those that don't deal with the problem on hand. At least it shows that my emails are getting through, hopefully. I had the strange feeling that my email had been already red flagged to go into their spam mail. I still haven't lost hope. Inappropriate?I sent two versions of a letter requesting review on my account. The first one was a nice one that requested a review since I was unaware of any type of spamming going on. I sent it to each of the emails that I have seen referenced by others. I sent that one each day for over a week.
I then sent a second one after about 6 days that mentioned that I was joining a class action suit regarding the disabling of accounts since I do have business contacts on FB. That is the one I received a response on and did get reinstated. Unfortunately it appears they only respond to the threat of lawsuit. Civility does not seem to work. -
Thats the point I made in my original posts here. Unless you threaten FB with legal action they wont budge, but the second you do that your account is immediately reinstated. -

Congratulations on getting your account back.
Now, be aware that it may well be tagged, so you need to be extremely careful. I can tell you from my own personal history that once you've been disabled once, they tend to single you out for almost any perceived infraction and disable you again. I have never received a warning for any "infraction," and FB has not offered any "proof" of the charges they have made against me, and yet they eventually "permanently" disabled my account.
So be cautious, and "behave."

This is so true. Since last fall when my account was hit by FB I have been threatend with deletion 4 times for sending to many friends requests to fast, sending messages to group members of a group i own with the same title to often and this being considered abuse if the TOS even though it was restricetd to just the group. They called it spam. -

As I look at the sight I see lots of "questionable" accounts.
Even more so, I see accounts with VERY inappropriate content— Vile language, sexual comments, inappropriate photo's, etc.—and yet, those accounts just chug away happily.
I'm still stymied by the last episode of my being disabled. (To be fair, I fully understood FB's stand on the first disabling, nearly a year ago, but as I was not even given a warning I had no chance to comply! THEY disabled me, "POOF" the account was gone. And of course once disabled one can't get to their page to comply!?! So, how does one FIX what they can't even see? When they finally reinstated the account, they had removed the content so, it was no longer an issue, or so I thought?) The last disabling has been since June, and still they have refused to reinstate my account. The charges are completely false, a defamation of my character and slanderous, at that. I suspect they never will reinstate the account, as to do so might just prove that they know they were wrong in their actions. And unless an attorney really takes this to heart and decides to help us band together, little will come of any of this. As I have said before, This is America, and I am very confused at when it became OK for someone to make charges against another, being jury and judge, and NOT having to prove those charges or substantiate them with evidence. But until FB users band together against the FB Policies, we are destined to be left out in the cold.

My only fault was getting caught up in a silly game and sending too many F/R's at one time, but since the people I added all belonged to a group created for the purpose of being added I don't see how they (FB) can call my actions harrassment. It's all very absurd, but I intend to keep trying. I was stupid enough to pay money through pay pal for these games and I'm not going to sit back and do nothing about it that's for sure! I have nothing inappropriate on my profile. They have been gunning for me ever since they disabled my ability to comment on stuff, back in May. I was unable to comment for a week. I don't know what to do. I am very distraught. I did nothing wrong. I don't spam people w/ requests. All I do is visit w/ my friends and play games. They won't respond to any of my inquiries. I don't know what I did wrong. I'm devastated.

Facebook posted proposed revisions to it's "Rights & Responsibilities" document (formerly called "Terms of Service" or "TOS). They asked for feedback from the Facebook community. At the request of many users, they posted a version of the document that showed where the changes were (new text in blue, deleted text crossed out). Unfortunately, most of the replies have been illiterate garbage, plus some requests for features that have nothing to do with the document.
I went through the document and made comments where I thought revisions should occur. I then saved each page as an image and uploaded them all to a photo album on my profile. You can see my markups at http://www.facebook.com/album.php?aid... I posted a link to this photo album in the forum where they have requested feedback. I am asking people (including you) to look at my comments, and, if you agree, to say so in the blog comments and also post the link so that Facebook will see that many users agree. You can also post your own comments in the blog, of course. Also, please share the link to my photo album with as many people as possible so Facebook hears a unified voice. Thanks.

Gee, Joanne, do you think you can think about something outside of yourself and your woes for even five minutes? I didn't go to all the trouble of commenting on the new TOS and then posting the above just so you could see if their new TOS would help you, personally, get your account back. I was asking people to comment on the new TOS so that, among other things, Facebook will be pressured to make the alleged 'violations' more specific in their TOS so that what happened to you, me, and them does not continue to happen to us or other people. It's too late now; the commenting period is over. And the link above won't work because they have since disabled my account. But, for pity's sake, please help think of some way to change the policies for evryone and stop whining about your personal situation! Or move it to another topic specifically for people with disabled accounts. -

Joanne, if you have another email address, you can start another Facebook account. Do you have a gmail address? Perhaps a Yahoo address? Your name is common enough that I'm sure the name alone would not trigger any alarms. Were you able to see my photo album? The photo album with my comments on their document should be visible even for people outside of Facebook usiing the URL I provided, however you will not be able to post a comment in their blog without a Facebook account. -

Hi ladies - I had my account back within two weeks - i simply told them that the unfairness of their action to disable my account was ridiculous as i was using an application they had written namely Mafia Wars. I told them that i had personal photographs on my profile that i had no other copies of as well and simply pleaded that they reinstate my account. It was done and i was very grateful. I do not think the strong arm threatening etc, will work - state your case and ask them to reinstate and then be careful never exceed their limits etc......good luck to both of you. -
Inappropriate?The only way i was ever able to get my account turned back on was to send a strong email and in it threaten them with a lawsuit and tell them that all the information and prior emails and responses were in the hands of my lawyer who was waiting for my approval to start the case against them.

I am so afraid to piss them off and have them call my bluff, that's the only reason I haven't threatened them with legal action. I actually work for a lawyer. lol I have, however, contacted a few class action attorneys in the San Francisco Bay Area to see if they would be interested in filing a lawsuit on behalf of everyone who has been unjustly disabled by FB, like all of us. I'm even afraid that they are black balling my account b/c I have been following up every day w/ additional emails asking for the status. I feel like a little kid whose parents are saying, 'the longer you bug us about getting off restriction, the longer you'll be on it." This is ridiculous. -

The frustrating thing is one seeing all these people getting their accounts back in such a short time and two all the obviously fake named accounts that are still on FB, and you can tell from a mile they're fake. Maybe some of them have ideas that are being reposted here. For the sake of keeping this topic relevant, may I respectfully ask that you take your discussions of how to get your account back onto one of those more relevant topics and leave this thread for people who are newly expressing interest in participating in the lawsuit? I am thoroughly in favor of a class action suit against facebook, IF the opportunity arises, I will be right there, at the beginning of the line. My hopes until then are that perhaps someone with the wherewithall to file or take on a class action suit might see some of the correspondences that have been going back and forth, and use them as a spring board to move forward... Afterall... it does appear that there maybe quite a few of us, and we here may just be the tip of the proverbial iceberg. -

I've contacted some class action attorneys in the Bay Area since Facebook is in Palo Alto, but I don't think anyone cares or takes it seriously. For those of us going thru it, it's damn serious. -

I'm so sorry Julie. :( I've been disabled since last Friday night and am not taking it well AT ALL. Like you, I've gotten no responses from them. The more research I do, the more I am seeing that the standard punishment is 2 weeks of being disabled. As long as you didn't have anything really egregious on your profile, or do something really bad, it will hopefully come back. I believe I was disabled for writing and sending messages too fast. The stupid FB server bot recognizes any fast actions as "spam" and shuts down the person's profile. My friends have even started a support group and petition to get me back. Hang in there, though. I am working with a man named Rudy, on the East Coast, who has done some very eloquent You Tube vids, to Mark Z. He is requesting a face to face meeting to discuss this problem. It seems as though a ton of people have been disabled over the past few weeks, for doing nothing more than adding friends too fast, deleting friends too fast, commenting too fast, sending messages too fast, etc. It's the "too fast" thing. Inappropriate?My account was disabled and when I asked them why they just said that I had violated there terms and exceeded their limits when sending out friendship requests. They claim to have told me to slow down however I received no warning. It said they would not reactivate my account for any reason, the decision is final.
I sent another message apologizing telling them that it was a mistake and that there are no limits stated and that everone I had sent a friendship request to had accepted and that in 3.5 yrs I had got 170 friends which isn't exceeding limits. They replied saying that my account is permently disabled, the decision is absolutely final and they will not explain again. Has anyone been in the same boat-being told the decision is absolutely final?

Inappropriate?Twice I had accounts permanently disabled by them. The only reason they gave was I was commenting/emailing too much and should use their chat instead. Commented too much on a SOCIAL NETWORKING SITE!!???? WTF???? I and two friends tend to have very active conversation in email and comments. WHY??? Because their chat never works for the three of us! I have requested that we would gladly cut this down if they fixed chat but never received comment nor was it ever fixed. This is my third account with them. Is it really that much a sin to have friends internationally that you like to communicate with?

Inappropriate?Happy to say my account was reactivated yesterday. Shocked that I was only off for 3 days. The email that they responded to was the first one that I sent...not sure if they saw the others and if that had anything to do with it.
I too was told I was over the limits...I did receive warning emails, but they didn't say WHAT I had done so...I didn't quite get it! LOL
I explained in my original email that I did Get the emails, but I was confused...others told me not to click on links and that it was a virus. I also explained that when I saw the alert boxes when I tried to post anywhere...I assumed that the computer was verifying I was WHO I am supposed to be by having to type in the coded words. I really did not know what I was doing wrong. So....they gave me my normal standard email, but did say after looking into my situation...they reactivated.
I will be careful...that's for sure...it's silly!

I did send 2 other emails to disabled, but I realized it was the first one that they responded to because I didn't use spell check and noticed my error in the title of the email! LOL...the last email I did send to them...not sure if they even read it or connected them all with ME, but I said that I had emailed and was waiting to hear....then went on to ask a question! I said that I was participating in polls and constantly refreshing. Asked them if that is what possible could have caused red flags to go up on my account. I heard from them the next day.
It seems there's no rhyme or reason.....maybe someone was just in a good mood! I don't know...It surely isn't fair! -

While there may be no actual damages, I think that a court would look at punitive damages for a multli-billion dollar company that supressing free speach. Inappropriate?I am an attorney in New York whose account was wrongfully disabled three months ago. Despite several requests to reverse the decisision, Facebook has refused to reinstate my account. the only "explanation" I have been given is that I requested too many friends too quickly. But isn't that what a social networking site is designed to do? Bring people together? I wasn't sending out mass mailings or spam solicitations. In any event, I would love to join the Class Action.

Inappropriate?I had my account taken away for about 6 weeks until I hired an attorney and threatening to file a lawsuit against them and to add an individual on f/book that was and is a very nasty person in every way. I did get my account back and then when they contacted me to have it enabled, they gave some crap excuse that it was not their fault. They just did not want my wrath and the lawsuit.
People have to do more than complain and "try". DO SOMETHING ABOUT IT.
MY ATTORNEYS WERE WONDERFUL and had it not been for them, I would not have gotten it back.

Inappropriate?I am so happy that someone is going to do something about this. I lost all my applications and then all my friends are gone. My family can log into there accounts and see all my games but I am locked out. I sent them several emails and my son sent them screen shots of all my applications I was using but they did not even get back to me. I deactivated my account and that was the only satisfaction I received.

You're wrong and I'm going to break it down to you in easy terms so you can understand.
When you create something like Facebook and let it grow to where people actually depend on it for the way they conduct business, you do have an obligation to your member base. You have an obligation to not only keep them informed, but to provide a specific level of service to all.
If they wish to shut down the entire site, that's their business, but if they provide the service to some, they must provide it to all when using a public domain like the internet.
If they wish to make it a members only pay site, then they can treat their members any way they please under the TOS agreements. -

You pay for your phone service, so of course there will always be a service level agreement between you and the phone company. Facebook, it's free, you knew that going in, they do not offer any SLAs, and they don't have to. Look at it like a drivers license, it's not a right, it's a privilege. -
Chris: Go away you awful troll. This is a site for people who are having problems w/ FB. You don't need to come on here and make disparaging comments to those of us who had our FB accounts disabled either currently or in the past. Didn't your mother ever tell you that if you can't say something nice, then don't say anything at all? The issue is not whether or not FB is a free service. The issue is their arbitrary disabling of someone's account, with no warning and then their lack of customer service or support to HELP you figure it out. Can't you see that this thread was borne out of sheer frustration? Last week, on a Friday night at 9 pm, FB disabled a game called Egg Breakers for 2+ days because one of the advertisers on Egg Breakers allegedly violated FB's very vague "terms of service". The app developers rectified the situation right away but were unable to reach anyone in person at FB to have them reactivate the game until late on Monday. That's just crap. Facebook says that one has violated their terms of service, but they refuse to give specifics because they allegedly "can't". That's what happened to me. I went over the limit for commenting and writing on walls, but I didn't know there WERE limits, and furthermore, when my account was finally reactivated after 17 days, all they said was that they couldn't tell me what the limits are. Do you really think that's fair for a social networking site to arbitrarily decide that a person has gone over a limit, when they don't TELL you what the damn limits are?

Inappropriate?My facebook account was disabled 72 hours ago and I have not heard the reason why they disabled my account. Facebook was my only way of communication to my Daughter, I am so upset. My daughter and I used facebook to chat and message each other after several years of silence between us. We were building a new relationship there.
Also the time I've invested in my Facebook account is valuable to me, many hours of work. I was in process of developing a Facebook application. My pictures, my comments all my notes all GONE! For faceboook not to recognize what they have done to my life is incomprehensible. I am still waiting to hear from them.
The process for appeal is primitive. The response to a person's disabled account is null and without warning.

Since fb is a free product and made available by good will (and ad revenue) there is no direct contract between the users and the company other than the "Term of Use" agreement of course, but as we all know Terms of Use in no way guarantees site availability, customer satisfaction response teams or any form of Service Level Agreement.
How exactly would this lawsuit be viewed by the legal community? -

My facebook was under my gaming name and when I tried to change it to my real name it did an auto scan and said that bella could not possibly be a real name. Which it is... I wrote them several times and they haven't gotten back to me. Freaking going back to Myspace or linked in. C.A.L.S. all the way!

Inappropriate?They disabled my facebook account due to some spam or some garbage because someone came onto my account and sent a bunch of random friend invites that was considered spam. That's fine, I emailed them and told them it is a mistake. They said no and that my account is disabled forever. Frustrated, I made a new account and had to readd everyone I knew over a course of 10 years and having moved between 5 cities all across north america (which was a pain in the butt) and I couldn't even find all my old friends anymore either that were on my original account. A week later they disabled this account as well saying that i cannot maintain multiple accounts....but they disabled my first one 'permanently' as they put it so I wasn't 'maintaining' any accounts at the time I made the new one because they told me I can never use it again...I wrote back to them asking them wtf and to read what I wrote because I clearly explained how I was not maintaining two accounts....I have yet to get a response. My last response took them 5 days to answer..

Inappropriate?I think it is immoral for them to confiscate our content. Since we have built it ourselves, it belongs to us. They even spell this out in their TOS.
This company has a lack of transparancy, an unwillingness to cooperate with its users, and a total lack of accountability.
If this lack of accountability is achieved through providing a free service, and therby avoiding having to appease paying customers, then that is also immoral.
The thing that really worries me is the amount of data they collect, with absolutely no policing on how they are allowed to use it. I have no reason to trust them.
Send a message to abuse@facebook.com and report the company itself for abusing people's rights to their own information, and its responsibility to treat its users fairly.

So I have decided to take up his original cause in organizing a class action lawsuit against Facebook for unjustly shutting down Facebook accounts. I'm not a lawyer but have studied law and am going to law school in the future. I've reviewed my own case and have preliminarily found 3 potential violations Facebook's terms and conditions violate out of the U.S. Constitution. I will be consulting legal counsel as well to determine the extent of violations that Facebook has committed against basic citizens rights. I have also worked with the ACLU in the past and will be passing this case onto them to review. What I need from you.. is to email me the details of your particular case so I may start to organize a class action.
I need you to be honest. If you are fairly certain you did actions to have your account deactivated, I ask you not to include yourself. I need honest cases where you truly feel Facebook has violated your rights by shutting down your Facebook account.
I would like to organize at the very least 5-10 people before presenting any type of case to legal counsel and the ACLU, and people will be able to join the lawsuit at any time right now. These guys who run this, sell our info for commercial gain and hold the power to disable (essentially publically embarrass a person to their friends and family with no explanation towards accountability from their end) and continue to campaign for new members, should be knocked down a few pegs. I was notified my account was hacked and then the next communication said I was disabled and they "couldn't" give me an explanation. These are the same guys who were already sued for selling OUR personal info to interested business concerns WITHOUT our permission or knowledge. I ask, then, is it "our" account or is it any other scam to suck up our personal info for gain?

I was completely mentally and emotionally devastated when my profile was disabled in August. My friends emailed FB on my behalf and even started a Petition Group to bring me back. I emailed FB several times a day. I emailed every address that my friends could find for me. I wrote them a snail mail letter. I complained to the Better Business Bureau in the Bay Area. I complained the California Attorney General b/c I'd paid for premium memberships in Hatchlings, Fairyland and Pet Pupz and was not getting the benefit of those. I lost a ton of time and credits in my various games b/c of being offline for 2+ weeks. No one ever responded to me. The BBB sent me a letter saying that FB wouldn't respond to them either. I got a letter from the CA Atty General saying that FB wouldn't respond. I contacted a ton of Class Action lawyers in the Bay Area, no one responded. I contacted various consumer affairs groups, including at my local (Seattle) TV stations, and no one was interested in exposing FB for these actions against their users. It's now been 4 months since my account was finally reactivated, after a 17 day punishment and let me tell you, I just don't feel the same way about Facebook anymore. Being told that I'm TOO social and punished for it is the most ridiculous thing I've ever heard coming from a social networking site. When I got my reactivation email on August 31, they stated that I 'exceed their limits' but 'unfortunately we cannot tell you what those limits are.' WTF? I mean seriously!!!!!

I find myself on FB less and less these days, and I have noticed that it's popularity seems to have waned over the past few months. People who were pretty hardcore about being on FB all day or night last year have scaled back dramatically. A lot of my old high school and college friends flocked to FB last winter and spring, but they haven't checked in since then, when we all caught up on our news of the last 25+ years.
I am sick and tired of the constant changes to our profiles. I am sick of having requests posted directly to my Wall instead of in the Requests area of the home page. I am sick of being scared that my account will be disabled for good if I comment too much in one night. -

Mine got hacked by the "I'm stuck in ___ and need money to get home" scam, so I quickly changed my password, alerted friends who use the chat feature, and reported the problem...and got disabled! Apparently, FB assumes that the user broke their rules...? Anyway, now they won't respond at all. If there's a class action suit, please let me know what is necessary to participate! -Mary

Inappropriate?I was disabled for what I do not know. I was never sent an email telling me about any abusive behavior I was doing. If adding friends is a crime oh well. I have spent money on games that I play on FB. They need to reimburse me for that money. If I am allowed to spend money on application on FB then I should be able to play those applications. Nothing was ever said or done that told me that I was warned. Their policy says that I would recieve a warning before my account was disabled. I did not receive this. They ae inviolation of their own policy. I changed my password as myy games I played were acting really funny and I know that someone could have hacked into my account. Ever since then they have blocked me or I should say disabled me. There is no recourse to state or talk to a human that you could explain anything that was going on. You are at the mercy of them. They should have a customer service so at least you have a case number and some kind of ligitmate account of what you have sent them. They do not respond to any emails. This to me is out rageous. What business goes along without any correspondence except for what you sent. How are we as networking socitalites suppose to deal with this. We are at the descretion of those who read these emails and choose whether or not to respond. What course do we have but to sue. They have changed their policies and never sent an email for the upgrades or changes to their policy. So as a common person how am I suppose to know when I have violated their policy. shouldn't they be sending an announv=cement out to all facebook users when they have changed their policy? No they only send changes when a state or big company sues them and they lost; that their policy has changed for privacy issues. any toher changes they do not let anyone know. You are just suppose to know the changes. (ESP I guess). Well enough for the ranting. I am so displeased with this FB. I was able to make new friends, contact my family, and friends that were long lost were able to talk to one another again. I thought this was great. I guess they have too much lose otherwise they wouldn't have put such stringent limits on people. I would whole heartly want to sue this company and their arroganace.

Inappropriate?Hello there, I am currently in the process of looking for an attorney to assist me in filing a suit against Facebook/Zynga. I have been playing Mafia Wars for quit some time now, building up friends (time/energy) and have spent hundreds of dollars purchasing points from Zynga through Facebook. I recently had my account disabled by Facebook for no apparent reason. What this means to me is that all the time/money put into it, I have now lost it all. I have sent numerous email requests too "disabled@facebook.com" with no response. It seems funny that the American people can invest time and money into their system and they can just cancel you out "disable" you without warning or reason while loosing out everything you put into it.
Any thoughts would be greatly appreciated.

My friend Darlene was kicked off in November and never reactivated. She had to start a brand new profile, but she lost EVERYTHING off her old one, including a bunch of games where she'd advanced to the top levels, photos, and notes she'd written.
Facebook doesn't care about us, and I could not find any attorneys who were interested in a class action either. I complained to the BBB in the SF Bay Area, as well as to the California Attorney General, b/c I too had spent money for Hatchlings, Fairyland and Pet Pupz. Facebook refused to respond to their inquiries on my behalf.
It sucks, but all you can do is wait it out. I tried sending daily emails, I tried faxing them, writing a snail mail letter.....I tried to find an attorney, I even tried the consumer affairs reporters at the local Seattle stations where I live. Not one person responded or was interested.
My experience left a terrible taste in my mouth, and I don't feel the same way about FB that I used to. My offense was that I commented too much and wrote on Walls too much. I had been pink slipped for it, but I never thought they'd kick me off. What's the point of a social networking site if they have limits? Yet they can't tell you what those limits are, till you get kicked off for exceeding them. My friend was kicked off for adding and deleting friends too fast. Basically, if you do anything 'too fast', the Facebook spambot picks it up as abusive behavior.
Hang in there, and hopefully you will be reactivated w/in 2-3 weeks. I was disabled on 8/14, and received an email from them on 8/31 that after further review, they'd give me a second chance but the next time it happened they'd disable me for good. I was so embarrassed that it happened to me, and I'm not on FB near as much as I used to be, b/c I really hate what they did. I hate their constant and unnecessary changes. If it wasn't for the fact that I've made so many new friends and gotten back in touch w/ so many old friends, I would have deactivated my profile. As it is, I have been printing hard copies of all the stuff I want to save, in case it happens again. -

It sucks, but all you can do is wait it out. I tried sending daily emails, I tried faxing them, writing a snail mail letter.....I tried to find an attorney, I even tried the consumer affairs reporters at the local Seattle stations where I live. Not one person responded or was interested.
My experience left a terrible taste in my mouth, and I don't feel the same way about FB that I used to. My offense was that I commented too much and wrote on Walls too much. I had been pink slipped for it, but I never thought they'd kick me off. What's the point of a social networking site if they have limits? Yet they can't tell you what those limits are, till you get kicked off for exceeding them. My friend was kicked off for adding and deleting friends too fast. Basically, if you do anything 'too fast', the Facebook spambot picks it up as abusive behavior.
Hang in there, and hopefully you will be reactivated w/in 2-3 weeks. I was disabled on 8/14, and received an email from them on 8/31 that after further review, they'd give me a second chance but the next time it happened they'd disable me for good. I was so embarrassed that it happened to me, and I'm not on FB near as much as I used to be, b/c I really hate what they did. I hate their constant and unnecessary changes. If it wasn't for the fact that I've made so many new friends and gotten back in touch w/ so many old friends, I would have deactivated my profile. As it is, I have been printing hard copies of all the stuff I want to save, in case it happens again. Good luck. :) -

Inappropriate?Filing without an attorney can be good if we get a competent judge, as the laws require him or her to apply the meaning and applicable claims, based upon our sworn statements that will accompany the Complaint.
One reason this may be helpful is that our Complaint is not going to be of a common nature, i.e., we cannot sue for "breach of contract", as I do not believe we can claim it because there was no "consideration" (Payment).
For everyone that is willing to be a co-plaintiff, please email me (privately at GOatNYCAPdotRRdotCOM) a clear and short description of what you experienced and how you were harmed along with your full name and street address and phone number.
My interpretation of the NYS laws is that I cannot represent myself as a lawyer (I AM NOT A LAWYER) and I cannot get paid (PLEASE DO NOT EVEN OFFER TO COMPENSATE ME FOR MY EFFORTS) and I cannot prepare your papers, hence, I need your words so we can prepare the papers together and they make sense to the judge, as that is critical. And he or she will appreciate that and they certainly won’t want us to file a bunch of complaints. I am sure that the judge will see this as a class-action lawsuit.

Inappropriate?You have to sue Facebook in Santa Clara County, they dictate that in their terms of service. If you don't, the judge will throw out your case as being in the wrong venue. I encourage everyone to file a small claims court case in Palo Alto Court, Santa Clara County. If there are enough individual cases I think FB will get the message.

david: While your comment was not meant to raise a concern, I just wanted to be sure that everyone that will take this step with us understands that the case can be filed in Santa Clara County.
However, I believe it can be filed in any federal court and, based on my experience, if they want to have it removed they would have to make a motion and that would provide us the opportunity to file a cross motion to remove to California. -
Also, I believe that all of the judges in the Northern District of New York are dishonest (Munson, Sharpe, Walter, etc.), so I certainly will not file one there until I can prompt our public servants to address that anomoly one day.
Does anyone know if one court in Santa Clara county has more desirable judges that render fair and honest decisions? -

But I thought Facebook was located in Palo Alto, which would make it San Mateo County. You'll need to look over which correct Judicial Council Forms to use.
