mic doesnt work only with voice dial

My Zivio doesn't voice dial. It used to work. now it's like the mic is off (or on mute). I double tap, get the message in my ear to say a voice tag, I say it, but it never hears my voice. just times out. when I use the mic for anything else like talking or recording a voice mail, it works fine. is there anythingI can try?
while I've got you here, it also never shows a green led after full charge. just goes from red (charging) to off.
I love it otherwise
