Right to download Tiles
Hello,
Can we use the tiles of Google and Miscrosoft without using their API? Even for a commercial purpose?
With modestMap, we don't need a key or to register... That would be strange if we can use tiles without notifying Google or Microsoft no?

You don't have the *right* to use their tiles with Modest Maps. But you might get permission if you ask, and they might not notice or care if you don't. It's up to you to assess the risks.
We (Stamen) sought permission from Microsoft before using their tile servers for Trulia Hindsight and they seem to be fine with it so long as you display the correct copyright. There's a copyright.js file in the subversion repository that will help you do that, and the as3 version will dispatch events whenever the copyright needs to be updated. This has only really been tested properly with Microsoft's copyright data, but Google's should work too.

Inappropriate?Well, it seems that Google does not allow direct use of tiles, not event in case of Googles Enterprise/premiere license. Here's short answer from Google:
"As far as I understand you would manage the map tiles directly instead of using the Google Flash API. It is not permitted by the terms and conditions of the free and the Premier license"
