The license for Windows is tied to your system's BIOS, and third party affilliate software installed on the factory image actually helps subsidize the cost of the OS.
It would therefore usually more expensive to ship the PC without the software, and therefore there is no refund to be given. Your PC probably would have cost you more if there was a way to ship it without a Windows License.

When Vista was released, virtually all computer manufacturers were promoting the new OS on their sites, not just Dell. The reason: the OS was new and offered features which weren't available for Windows XP. All PC manufacturers were compelled to move along with the times in order to remain competitive.
The contention that Dell was the first to recommend Vista may be true, but if it is, it is only true by minutes :-|
Vista, though not as popular as XP, did represent great advancements in Microsoft's OS, as does Windows 7 today. I'm sure when Windows 7 is released for sale, it will be immediately recommended by PC manufacturers also. It will represent the latest developments in Windows' technology.
I'm not exactly sure how this represents a breach of trust to you, but I am sorry you feel that way. :-(

I don't recommend using third party batteries to anyone, and this situation perfectly illustrates why. There's just no way we can be sure the battery is working properly, or that the battery is designed to Dell's specifications.
It could be that the system isn't recognizing your third party battery, or it could actually be a problem with the system itself. Do you still have the old battery? Was the system behaving any differently with the old battery, i.e. was it turning on but wasn't lasting for more than a few minutes? If the answer is yes to both those questions, you can almost completely rule out the system as hathe source of the current problem.

I've honestly never seen a problem like this one.
The choice is really up to you though. I've known David for several years, and you honestly couldn't be in better hands.
If I were in your shoes, I'd take option #2. Having a gifted technician like David going over a system before having it in your hands is a pretty amazing sale point.

You won't *see* drivers on the disk. The native keyboard software installed with XP supports the fn function of notebook keyboards. Searching for the drivers will disappoint you, because you won't actually *find* them.
If your fn key isn't working, there is no special driver file that will make it work. The driver is native, much like your CD Rom or your basic Windows VGA driver for monitors.
Have you checked the bottom screws to make sure they're all tight and in place? If that doesn't work, you may want to run the keyboard diagnostics by booting to the drivers and utillities CD supplied with your system. The keyboard may be flaking out.
