A comment on the question "Spotify may be great, but how did my music get there and is anyone planning on paying me for it?" in Spotify:
The whole world is built on a system of trust. If it wasn't then it would be almost impossible to function in society. As an example (valid in Sweden at least, but just to illustrate the point), children would not be allowed to use their weekly allowance to buy a piece of candy on a saturday, since they do not have the legal right to enter a transaction by themselves. The store has to trust, based on common practice and reason, that a child may enter a store on a saturday with a small amount of money, and proudly buy their own candy. Asking the child to get their parents to confirm the purchase, and asking for identification and a certificate of parenthood to make sure that they really are the childs parents would be cruel, unjust, and plain silly. Common practice and reason are a valid legal defense in this case.
There is no reason to believe that a large, world-wide distributor would knowingly distribute music that it does not have have the right to distribute. If such a distributor exists, then it will surely be sued out of existence by the artists.
It is fully conceivable though that such things may occur by mistake, and it really would not a big deal if it happens in a few cases since it is so easily rectified. It is even more understandable that a distributor and an artist might have a different opinion on the kind of agreement that they have, but that is an issue for artists choosing their distributor IMHO.
