Amazed to report that this has been taken care of to my complete approval. Got a twitter from @casemate and sent them my contact info. Talked to a representative over the phone and it was awesome. They took care of my issue and after getting a replacement case of a different model I am happy to report that after a few months of use none of the issues of the other and complete satisfaction.
Thanks to case-mate for not just letting this go since it was so old and really taking a complete about step on how to handle customer service. Well done.

Case Mate Naked Case Scratches iPhone 3G
I purchased two of the Naked Cases mine and my wife's iPhone 3Gs. We were some of the first to get them and at first they were great but then we started noticing the scratches on our iPhones.
Seems they didn't consider the new plastic shiny back in the iPhone 3G when they redesigned the case for the iPhone 3G. The clip of the case causes scratches in the back of the iPhone when you open and shut it. I noticed scratches on mine and my wife's after about a month and it progressively is getting worse. The edge around the clip that holds the two pieces together is a bit sharp and must be hard enough versus the iPhone plastic to scratch it every time the phone goes in our out.
I would highly recommend 3G owners not buy this case if you, as I do, remove your case a lot to use a dock as it may really scratch up the back of your iPhone.
I contacted Case-Mate customer service and the response I got was less than stellar. I asked if this is a known issue or if our scratches may be due to the early run of our cases (we were on back-order from the release of the phone). My solution proposed was if the scratches are abnormal and the result of a bad manufacturing run then we could be happy with an exchange and if not maybe a different case type so no more scratches. Their response was in short" Unfortunately,Our guarantee does not cover product damages that may have result from normal wear and tear or misuse/abuse of the product. Case-mate will not be liable for any indirect, incidental, or punitive damages arising from the use of this product." They never approached my question or engaged me other than retyping their return policy.
