Will Bing Cashback honor their advertisement for 35% cash back on AT&T phones?

I recently responded to the circled ad in the screenshot below:



As you can see, the advertisement is for 35% off AT&T phones, and no further restrictions are listed. Since the second ad includes the restriction "With New Plan" I would have expected to see the same on the first ad if it was subject to the same terms.

After clicking the circled ad above, I was given the confirmation shown in this screenshot:



Note the words "Please wait while we send you to your store" and the activity indicator underneath - this confirmation overlaid the AT&T page for some number of seconds then automatically faded into the AT&T store behind it. I could see this confirmation for long enough to be assured that my 35% cashback was active on the AT&T store.

After making my iPhone purchase, I noticed my cashback did not show up on Bing's site. I followed the instructions to report the discrepancy and sent the requested documentation. I received a quick response informing that this cashback offer was not available for upgrades. From what I've been told by Bing Cashback support there was a link somewhere on AT&T's site which contained additional terms that I should have located and read prior to my purchase. It is unfortunate that these terms were not clearly presented to me as part of my purchase process.

I have made every attempt to resolve this directly through Bing Cashback but the representatives keep repeating that I should have looked for and read these additional terms on AT&T's site prior to making my purchase, even when presented with the logic that any significant restrictions to an offer should have been clearly listed both on the advertisement itself and as part of the purchase process. After going in circles a few times I stopped receiving responses from support, without my concerns having been addressed.

I believe it is the obligation of Bing Cashback to honor the offer they advertised, and request that my cashback be processed. My ticket number with Bing Support is SRX1105754376ID. I have not lost hope that Bing Cashback will be a valuable platform for both consumers and advertisers but it all hinges on being able to trust what is advertised.

    I have exactly the same issue. I clicked on the same Bing Cashback link. I found this offer hard to believe so I looked at each page I passed through on the AT&T website looking for special conditions and didn't see any.

    I reported this to Bing Cashback support (SRX1105528107ID) and they told me the same thing they told you: that the cashback only applies to new lines of service. They essentially called me a liar by telling me that I DID see the conditions as I placed the order, not just that I should have seen them. They kept giving me a link to an AT&T page that mentioned that condition. I told them that such a page has no meaning if it was not presented to me at the time of purchase. They insisted it was, and generally said it would have been at the bottom-right.

    I asked them these questions:

    1. What EXACTLY do you claim that I should have seen in the bottom right-hand corner? Would the complete terms and conditions be there, or would there have been a link, or exactly what?

    2. If a link, exactly what was the wording of that link, and what font size and color was it? I.e., would it have been reasonable for me to recognize such a link as something I should click on? If you have a picture of what that web page was supposed to look like, that would be better than a verbal description. But a description would be better than the zero information you have told me so far.

    3. If a link, what is the EXACT URL the link went to? Please don't assume it was the AT&T page you quoted me.

    4. Do you have any evidence, like from your or from AT&T's web server logs, that I was actually shown whatever you claim I should have seen?

    Their response was "I will not address the miscellaneous statements and questions which are superfluous to the issue at hand, that you have been denied and you do not wish to accept that. This would be a pointless exercise." I actually asked the questions several times along with arguments about why these questions were totally relevant, and that was basically the answer they gave me each time.

    Part of my argument rof the relevance of these questions was that Bing's own terms and conditions include these, but this was all ignored also as being extraneous:

    "We rely on participating online stores to report purchases to us. Stores may not report your purchase to us if they determine that your purchase did not qualify for cashback savings because you did not comply with this contract or additional terms disclosed on the store's site .."

    "There may be additional or different limitations on purchases at certain stores, and those limitations will be disclosed on the store's site. Your participation in the Bing cashback service on such online stores will be subject to this contract as well as any additional terms and conditions disclosed on the store's site. In the event of a conflict between any of this contract and those terms and conditions disclosed on the store's site, the ones disclosed on the store's site will apply and control."

    I asked them how I could escalate this complaint and I also asked this of the @bingcashback person on twitter. They told me to post a message on

    I have posted two messages on there so far, one a few days ago saying I didn't like one-way conversations over web forms, so I gave my email address and phone number and asked someone to contact me. They didn't. The twitter person insisted that if I leave a real complaint on there with questions, some one would contact me. I filled out the form with the following message on 7/10/09 along with my email address and phone number again:

    "Complaint about how I was handled in SRX1105528107ID. Last guy Stu S. said my questions "superfluous to the issue", but questions totally relevant. Bing terms say merchant's website will disclose additional terms. I and others claim did not see any cashback terms on AT&T's site when we ordered. I found 35% offer hard to believe so looked carefully at every AT&T page.

    If for whatever reason AT&T's pages failed to mention condition of new line of service, then condition isn't legally in effect, no matter what AT&T might say on other web pages! Or perhaps AT&T had link to conditions, but link inadequate in it's wording, size, color, or whatever, to effectively give notice. So my questions totally relevant, If hard to answer, Stu S. should have told me he couldn't get answers.

    Pls investigate AT&T pages and answer my questions! If find AT&T violated your terms, force them to give cashback for upgrade orders."

    I haven't heard back yet, but it's too early to expect that.

    I had a similar issue and opened issue #SRX11057589641ID. Bing Cashback support was extremely unhelpful and basically sent form responses without even answering the issue, even when I asked for escalation. Very disappointing. I was excited when I heard about Bing Cashback, but this first (and probably last) use of it has been disgustingly frustrating. Here is an example of the back and forth with Bing support:

    No outbound click? I would like to see the click history for my account then. I know there are a number of clicks to that AT&T promotion from my Bing account because that is the reason I signed up for Bing Cashback in the first place. I understand that you can’t do anything and, therefore, would like the contact information for the escalation point. This is wholly unacceptable and fraudulent.

    I have the same exact issue. Clicked on the bing result that said Buy an AT&T cell phone and receive 35% off. Followed each and every steps and was careful enough to look for if there were any such Terms and Service. There were none.

    After I bought the phone, by clicking at the link and login on to bing cash back, I didn't see any amount balance in the bing cash back account. Since then I have contacted the @bingcashback on twitter and on the email. But they are now referring to a new Terms of service which was not on any of the webpages while I purchased the iPhone. They just started emailing the terms of service. They cannot just do that. After buying an iPhone, signing a 2year contract with AT&T, activating it, and by just sending email saying that I don't qualify for the discount I was promised from the ad, is just ridiculous.

    And on the top of that, even as they are now saying that upgrade does not qualify for the bingcashback, on this tweet that comes out of @bingcashback says that this guy is getting cash back even he upgraded to the iPhone. Here is the link: http://twitter.com/bingcashback/statu...
    They still say that upgrade is not qualified and still advertises as it does. This is completely bogus.

  • Hi, I have the same problem. Bought an iPhone from ATT after being diverted by Bing. So cruel of bing to say that since this is an *upgrade* I dont qualify for the 35% cashback. Really, Google is the best and I am now eagerly waiting for the Google OS. I will dump MS OS ASAP and I think departure of Gates set the tone for decline of MS anyways.

    I was also tricked. My problem is that they claim the reason I am not eligible is because it was an upgrade, however AT&T's site CLEARLY told me I was NOT eligible for any upgrade, I had to pay the more expensive price for the iPhone.

  • You know, I was suppose to get $250 for a purchase this ebay from live search cashback (bing's former title). I paid for the item, paypal and ebay both took their cut, and after waiting 60 days for the purchase to post and an additional 15 days to try and cashout the funds, I got denied. After a bunch of calls and such, I was informed that they determined my account was found to be used in "collusion" by paypal and so the purchase wasn't good for cashback. I think the funniest part of the whole thing was that the purchase was completely ok when paypal and ebay took their cuts of the money from the seller, but all the sudden when I am suppose to get $250, NOW the transaction was guilty of "collusion". I followed all of the terms that were laid out for ebay, paypal, and live search cashback, yet they still found a way not to pay me. I say good luck in trying to get it...all I got was my account closed so I can't use the service again...load of BS I say...
    • Please don't be offended by these questions, but I need to ask just to make sure. Were you in collusion with the seller? I.e. was there any side deal with the seller that actually did violate the terms of service? Did you know the seller in advance? Were there any ebay messages or email or any other type of messages back and forth between you and the seller?

      I am assuming from your post that you were accused unfairly, but you don't come out and cleanly say that, so I want to make sure.
    • Don't worry, I am not at all offended. I was not in collusion with the seller. I did know the seller in advance, however as the ebay TOS states, you may purchase from a known seller if you use the buy-it-now action, which I did. There were no messages between me and the seller. I suppose I should have been more specific. They were never able to specifically tell me what the issue was, just that they determined I was in collusion (not able to give proof, even though I was the accussed lol. Pretty hard to try and fight it or explain yourself when they won't try and talk it out)

    I too was scammed. My ticket number is SRX1105780211ID. I also took screen shots of my purchase just in case. I figured that two upstanding companies like AT&T and MS made this a pretty solid deal but boy was I wrong! I've contacted both companies and they point the finger at each other and feign ignorance. When making the same case as others posting Bing support told me that it was ATT that set the terms, then ATT told me they had nothing to do with this offer. Like others here Bing has stopped responding to me. I recently reserved the domain name Bingcashbackscam.com. I am on vacation this week but as soon as I get back I plan to put up a forum there. Maybe we will see MS step up before then and do the right thing and honor the offer but I doubt it.

    • Note the link at the bottom right "For complete terms, please click here." Did you happen to click on that? If so, did you save a screenshot of that?
      I would be very surprised if those "complete terms" had anything to do with the AT&T offer; from the context, those would have been more details about Bing Cashback in general, since that's what the rest of the page was about.

      I understand why you don't want to post your other screenshots, but please look through them again and make sure that there is not a hint of the special AT&T conditions for this offer anywhere in them.

    • PhoneTrips following u on Twitter. In response to your question, no of course I did not click on the terms link, like most people for better or worse I blew past it. I did, however, read the fine print on that page in the screenshot closely. That of course, was my argument, which fell on deaf ears with Bing, that something as important as an upgrade exclusion should have been prominently displayed on this page. One of the customer service robots at Bing gave me this terms link as part of their justification for screwing me http://www.wireless.att.com/cell-phon.... I do not know if it is the same url that the terms link on the cash back page went to though...

  • I’m short on time and have to deal with this bureaucracy
    So... I've been involved in this too (I've exchanged messages with both adamalex and PhoneTrips). I just finally got around to calling AT&T today to see if I could resolve this.

    Since I have an employee discount through my company with AT&T, I have an AT&T Premier account. I dialed customer support (611), spoke with someone in Business Care, and explained my situation. She wasn't familiar with the Bing Cash Back program, so she sent me over to the Rebate department. The Rebate department wasn't familiar with the offer either ("no, we're not doing rebates on this particular phone") so he transferred me back to customer support. In other words, I went full circle.

    The gentleman at customer support didn't know anything about the Bing offer, so he gave me a phone number for Young America - a company used to outsource mail-in rebate processing... and therefore not relevant to Bing. That was the best they could do, so...

    I initiated a formal dispute with Capital One. I think I've done my best to try and resolve this with both Bing and AT&T. I have documentation (a screen shot and printout of agreements linked off the screen shot), none of which even contains the word "upgrade".

    One of the documents that I printed was the AT&T Premier service agreement; if they can link that off the Bing splash page, there's no reason why they can't put the AT&T/Bing terms and conditions link there too stating that upgrades are ineligible.

    Furthermore, in the screenshot of the original post, the very last line of the fine print reads, "You cannot use coupons or discounts, or earn cashback for buying gift cards/certificates. For complete terms, click here".

    If there was another link that had stated that upgrades were ineligible, then that link pointing to "complete terms" is factually incorrect (deliberately or not).

    Anyway, I'll try and keep everyone posted when I have spare time.

    • ATT and MS are just hoping this goes away and we'll all get frustrated and shut up. I for one, and several other I have met, do not intend to drop this. I will not stop, ever... until someone honors the cash back.
    • Just a quick update on my charge back... I called my credit card company asking for a status update since I hadn't heard back from them. They rebilled me, and I found out that it was because I didn't return the merchandise.

      After speaking with the dispute center rep, I told him that 1) it would be difficult since it's a phone (and my only one), 2) I don't want to give AT&T/Bing an excuse to back out of their agreement on this, 3) why should I return the merchandise if it's not defective?, and 4) there are non-refundable charges if I don't return the phone within 3 days of receipt, and the 30-day money back guarantee window is gone too.

      I'll try and file a BBB report soon.

    Thanks for replying back to my email. I contacted ATT asking them if they had any "bing related terms and conditions" on their ATT premier website after being diverted there by searching "ATT Wireless" on Bing. They say they just had terms and conditions and are not ready to confirm in writing that that they had anything related to Bing on their website. So the merchant (in this case ATT) had nothing related to bing cashback in their terms and conditions. So your section 17 does not apply here.

    It seems these Bing cashback and upgrade related terms and conditions where put together later after MS came to know the amount of dollars they will have to shell out if they give cash back to all these customers. So as far as ATT is concerned, for them my order is placed on ATT Premier website and that's all. They want me to ask Bing for cashback. So I request you to send me the screen shots of the bing related terms and conditions on the ATT premier website to prove your say otherwise if you have no proof, please give me my cashback. ATT has no proof regarding this.

  • I’m disappointed that AT&T management is so ignorant about this.
    That AT&T email is weird because it just isn't possible that AT&T wasn't involved in the promotion. For people who did get the cashback from the AT&T offer, such as totally new lines of service, I bet AT&T reported the transaction to Bing automatically. I suppose it's possible that every single person who got the AT&T cashback had to complain to Cashback support first, but I doubt it. If I'm right that it was reported to Microsoft automatically, then AT&T's servers were involved.

    I have successfully gotten cashback automatically from other merchants, including last week with T-Mobile's cashback offer. T-Mobile was clearly involved because some ot their pages had a Bing Cashback logo, and as I say, the cashback was automatic.

    But the absolute proof that AT&T is involved is that the famous Terms and Conditions page that the Bing support people keep pointing to is on an AT&T server: http://www.wireless.att.com/cell-phon...

    Did Microsoft hack into AT&T's web server to insert this page? I don't think so. You should talk to Ms. Markey about this and get her explanation.

    • That's disappointing, and I notice they seem to be encouraging you to discuss this with them directly rather than continuing through the BBB. I'd recommend anyone using BBB to continue to reply to the BBB to let them know the issue is not resolved until the advertisement is honored. It is some extra work for you but it keeps the BBB in the loop so they are aware of whether or not Bing is resolving this issue for consumers.

    After reading Bing's repeated insistence that this promotion's terms are set by AT&T, I still believe Bing should be the one to assist us since the promotion was conducted on their site. However, since they seem to be unwilling to do so I do agree that AT&T is also responsible since their products and services were the ones being sold through this promotion. This promotion could not have been conducted without the participation of AT&T and in allowing a misleading advertisement to run, collecting the money, then failing to assist affected customers they have failed us also.   • Got some good news about my AT&T Bing Cashback claim on Friday.

    Received a call from an AT&T customer service representative regarding my BBB complaint. She was very polite and patient listening to a full account of my ordeal with this cashback offer. Apparently they have had a few of these same complaints come through her office as she told me that she had recently been in a discussion with a higher level manager and had been provided with screen shots that showed the Bing terms link at the bottom of the AT&T wireless entry page. She also explained to me how the cashback program worked with Microsoft in some detail and also that they had suspended/ended all cashback programs with Bing.

    She then politely told me that since the terms were available on the page that stated the offer was only for new service I was legitimately denied the offer. We then discussed how this link was not easy to and since there were more people than just myself caught by this and the fact that such an important exclusion should have been plainly stated up front. She agreed with most all of the points that I had been making in our conversation and I could tell there was some empathy for my situation. After a little more discussion she told me that she had no power to make the cash back happen, however, she was looking at my account and offered to give me a 1 month billing credit as a good faith gesture to help resolve my complaint. Well, it was not quite what I would have received with the cash back ($136); however, my monthly bill comes to $104.99, which is close enough to make me happy. She said that it would be effective immediately and sure enough when I got off the phone I went online and checked and I had the credit in my account.

    I also told her that I knew several others who were equally dissatisfied and asked if I could direct them to her since she was so helpful. She stated that she would not be able to help since she only worked with specific individual cases as they were given to her. The suggestion was for others to use the AT&T support contact page, to which I replied that most of us had already gone that route with no success. She seemed to indicate that maybe a BBB would be the best route for the others since they all get routed / addressed the same way and that those complaints are taken seriously.

    I thanked her for the helpfulness and told her that I considered my complaint with AT&T resolved. I don't know if an account credit for you guys would be enough compensation but it seems they are willing to give some reconciliation for the trouble incurred with this program by complaining to the BBB.

    I still consider my complaint with Microsoft unresolved and will report as such with any follow-up by the BBB as they never even bothered to contact me personally outside of form letter email.

    While you may consider this incident closed, I cannot consider the complaint with the Better Business Bureau as satisfactorily settled since your organization erred by claiming to have pulled back a promotion yet continued to have an active link that showed that a credit would be made. You should know, this is now getting quite a bit of attention on the internet and a number of us now have a forum dedicated to complaints around this offer. It seems like it would be easier and cheaper just to do the right thing and honor the promotion that you advertised, however, those of us who were scammed by this offer will not let it go and continue to fight this until Microsoft eventually honors their obligation.     I do not routinely take screenshots of the transactions that I make online because in almost 10 years of ordering numerous items online, I have never, ever been asked to prove something via screenshot. The only information I ever need is included in confirmations or receipts sent via email. I assumed that a technology giant such as Microsoft would systems in place sufficient to do business online just as any other online retailer does and trusted that this transaction through Bing Cashback would be as smooth as most of the online transactions that I have made in the last 10 years. If I have to record everything that happens during the course of a transaction with Microsoft in order to be dealt with fairly, I would rather just deal with another company altogether.

I'm very sorry that you were unaware that the promoon had ended, but the merchant does control all cashback promoons offered on their site as well as the percentages offered for their items. They do have the final say regarding when and how long they are offering certain cashback percentages and we are unable to credit a promoonal cashback percentage outside of the promoon. I am very sorry for any inconvenience or disappointment this may cause you.

  • I’m happy, but it is rediculous that these giant corporations would do this to us.
    Because our dispute is about iPhones and therefore involves AT&T as well as Microsoft, the answer is to file a formal Notice of Dispute with the AT&T Legal Department. This forces them to take you seriously and make a reasonable settlement with you because if they don't, they will have to pay all the expenses for an arbitration and if the arbitrator rules in your favor for more than their proposed settlement, you will also get a penalty of $10,000 plus double your attorney fees. I did this procedure and it worked beautifully. The AT&T Legal Department got my notice and a paralegal called me to get details. Her department then contacted someone pretty high up in Microsoft and got Microsoft to agree to send me a check for the full 35% cashback amount, AND AT&T is also putting a nice credit on my wireless bill for my trouble in fighting this.

    Depending on where you live, your Notice of Dispute will be handled by different legal departments they have for groups of states. But she told me they are trying to coordinate their responses so that any of their departments should handle this exact type of dispute the same way.

    Look at the form called "Notice of Dispute".

    If you haven't done this already, call AT&T Wireless at 800-331-0500, describe the bing cashback program to them (they probably never heard of it), and demand that they give it to you. They probably won't be able to find out anything and will refuse to credit your bill for that. Then fill out the Notice of Dispute and mail it by Certified Mail to the specified address. They should contact you after a few days.

    Don't worry about any personal feelings you may have that Bing is more involved than AT&T. In the documentation you attach to the Notice of Dispute, include a couple of emails from Bing saying that AT&T is totally responsible. It isn't up to you to decide whether Bing was right or wrong; take those emails at their word and take the position that AT&T is responsible because Microsoft said so and Microsoft wouldn't lie. Also at this point they have some of these emails from Microsoft to me so they already know what Microsoft tells people.

    I can also personally vouch for the success of the Notice of Dispute procedure through AT&T's legal department. This completely resolves this specific issue for me, but it was in no part due to any assistance from Bing Cashback. Thinking about it, the reason for this is clear: when a company like AT&T partners with Bing to offer cashback rewards, this is a mutually beneficial business relationship designed to increase revenue for both companies. Bing's actions have shown us that maintaining these business relationships is much more important to them than helping customers who fall victim to a misleading promotion. Use Bing Cashback at your own risk.

    Summary: Microsoft is trying hard to gain Cashback users, but they are turning enthusiastic customers into vocal opponents. For people thinking of using Cashback, I hope you're a gambler. Proceed with caution and good luck seeing any money back.

    Bait and Switch: It's unfortunate so many people are having the exact same issue I am having with Bing Cashback and the AT&T iPhone promotion. After a few months of trying to resolve this issue peaceably, I have now been pushed into a corner.

    Here’s a logic scenario: If you’re in a gym and there’s a sign that says you cannot “run, jump or swim with Bubblegum (chewing) in your mouth” you would think those things cannot be done while chewing gum, but as long as you are not chewing gum, you can run, jump, or swim. No normal person would think that, regardless, there is no running and no jumping. However, if you're not chewing gum, you can swim. Confusing? Read on.

    I'm sorry for the confusion. The part of the Terms and conditions you are referring to says, "The following purchases on www.wireless.att.com are not eligible for Cashback Rewards ("Excluded AT&T Purchases"):
    a. upgrades, add-a-lines or device purchases with GoPhone (prepaid) service"

    This sentence means that upgrades are not eligible, add-a-lines are not eligible, and GoPhone (prepaid) service is not eligible. So you see; all three categories are ineligible. We apologize, but AT&T has set forth their own conditions on which purchases are eligible for cashback and Microsoft is bound by these conditions.

    If Bing was bound by these conditions, they should not have claimed we were eligible for the cashback, cleared us for the cashback purchase, then after we entered into a contract with their advertiser, reneged on Bing.com's advertising promise.

    In other words, Bing is saying, "we advertised a promise and had you buy a product fully expecting to get money back, but now that you've bought the product from our advertiser, it's not our problem." Classic bait and switch.

    By saying this, Bing publicly admits their system is open to fraud, intentional or not. This may be a technical/business process oversight, but even so, Bing bears the responsibility of fixing the problem. Otherwise I can set up a store, sell products for full retail with the highest cashback % I can get, then put in tiny, ambiguous and hard-to-find fine-print legal jargon that essentially no purchase is possibly maybe almost always eligible for the cashback.

    Confusing? Well, after customers have bought from me (since who wouldn't trust a cashback promise from Microsoft?), the customers (victims) are stuck with the bill. Bing openly supports this and points their finger at me (like they are doing with AT&T) while I (and AT&T) laugh all the way to the bank.

    The sad thing is, I used to be a strong advocate for Bing. I'm part of a group that spends millions on Google, and I wanted someone else to challenge them. So I welcomed Bing with open arms. Now I'm pressed to speak out against Bing, and to make this opinion and my bad experience well known among all of my clients. I honestly hoped for a different outcome.

    I have a problem too. They won’t honor the cash back on my purchase. I have a legal account and have checked off their listed reasons, methodically, why there might be problem (Two systems with different operating systems). I will just send back the merchandise at the company’s expense. See their response below:

    "After looking into your issue, we have determined that unfortunately, we cannot credit this purchase to your account. When you move from the Bing cashback site to the merchant site during a purchase, our system logs a record of that movement, also known as a Transaction ID. When cashback doesn't show in your account, in many cases the first thing we do is look for that record. If we can't find the record, we don't know that you went to the merchant through the Bing cashback site. We therefore have to conclude that your purchase is not eligible for cashback. We apologize for the inconvenience."

    I wanted to buy other items but I got nervous; not getting feedback showing MSN was seeing the transition. I did not steer away from the site. They have problems in their system and we are paying for it. It’s too bad.

  • I ordered a camera from tigerdirect and had Bing cashback enabled on it along with the Bing Gold dollar sign showing $61.85 amount of cashback. I saved that page as evidence because I knew tigerdirect or bing or both will deny. And that's what happened. Now I have proof of the webpage when I was ordering my camera from tigerdirect and presented the same to both (logged a complaint online on both the websites) but still they deny that my order did not go through bing.

    This is height of fraud. I have evidence and still they deny. That too for a mere 60 bucks. Will they both take these 60 bucks up when they go up. I don't care for 60 bucks but shows how shallow these people are and how poor is their level of service committment to customers.

    • You can try and do a charge back with your credit card company. Capital One didn't handle this very well... they're used to defective merchandise and companies that don't issue refunds, so it took months for them to take care of this.

      Or you can take it to small claims court. I'd try the credit card charge back first, since they can credit your account directly.

  • I've been meaning to post this for a while, and I'm just now getting around to this.

    I did file a Notice of Dispute with AT&T (along with all documentation) and they resolved it immediately. Bing issued me a check, so everything worked out.

    Thanks guys for the tips on this. To AT&T's credit, they did fix the issue; the problem was finding the right channel to contact them (since their 611 customer service team didn't know anything about this).
