As a legal researcher I would like to know the protocol you use to determine that a site is tracking. That would help tremendously in providing evidence in our lawsuits to stop the tracking.
I am confident the information supplied by Ghostery correctly defines which groups are tracking but to reply to Defendants responsedenying allegations we have to supply a protocol that actually shows they are at fault.

A clear definition of what Ghostery looks for is available from Wikipedia: http://en.wikipedia.org/wiki/Web_bug. In Ghostery lingo, they are 3pes or trackers. Any 3rd party that is embedded on a publisher site has the ability to record tracking information about a user.
