I’m concerned

Would like some clarification on the Jolicloud EULA

I would like some clarification, regarding the Jolicould EULA.

In particular, I would like a bit more information regarding this statement:

"You hereby grant to Jolicloud a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable and transferable license to: (i) reproduce, modify and publish any Content that you use; and (ii) distribute and/or display through the Jolicloud Software any Content that You provide or make available using the Jolicloud Software for the sole purposes of making the Jolicloud Software available to You."

To what content is this referring? Is this stating that, if I send an e-mail, via G-mail or some other e-mail client, that I've now granted Jolicloud the right to use the information contained in that e-mail for what ever purposes they choose? If I create a document in OpenOffice on my netbook running Jolicloud, I've now granted Jolicloud the right to do what ever they want with the contents of that document? Or is "Content" just referring to information relating to my account information and PC specs?

Please clarify what Jolicloud is referring to as Content. I really like using Jolicloud, but not enough to give up rights to all of the data I create on my PC.

  • Well, without a satisfactory answer from the founders/developers, Jolicloud is not a solution for me. Usability is great, but not at the price of losing control of my content.

    Can anyone elaborate on Jolicloud's meaning of "content"?

    Hello,

    We also think that EULA (End User License Agreement) should be improved, we are currently reviewing it and we will update it soon.

    Of course, we do not have access to the content you create from applications beside the Jolicloud desktop.
    We do not (and cannot) read your emails, your office documents, etc...

    • Thanks, Cedric. As I mentioned, I really liked using Jolicloud and I think reviewing the EULA/User Agreement is a great idea. It wasn't quite clear to me to what content Jolicloud required unlimited access, although I speculated it was only content relating to desktop usage. However, this day and age, it's dangerous to assume anything, so I didn't want to take the chance.

    "You retain your rights to any Content you submit, post or display on or through the Jolicloud Services. By uploading, submitting, posting or displaying Content on or through the Jolicloud Services, you grant Jolicloud a worldwide, perpetual, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such Content in any and all media or distribution methods (now known or later developed)."

    If you "You retain your rights to any Content you submit, post or display on or ***through the Jolicloud Services***", what does "By uploading, submitting, posting or displaying Content on ***or through the Jolicloud Services***, you grant Jolicloud a worldwide, perpetual, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such Content in any and all media or distribution methods (now known or later developed)." mean?

    Surely by using Jolicloud at all then you are using Jolicloud Services to post any form of content.

    Is the term "Content" restricted to anything posted directly on the Jolicloud services such as reviews, tweets user chat etc., or does it extend to anything you post such as to Google Sites or Facebook?

    I could understand the new EULA if it said:

    "You retain your rights to any Content you submit, post or display on or through the Jolicloud Services. By uploading, submitting, posting or displaying ***Content on the Jolicloud Services****, you grant Jolicloud a worldwide, perpetual, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such Content in any and all media or distribution methods (now known or later developed)."

    i.e. anything posted ON Jolicloud Services but excluding THROUGH Jolicloud services.

    But that is not what it says. What it does say looks like a very scary EULA to me.
