Flight Delay Compensation

I'm trying to obtain some clarity on why Thomas Cook think they are not due me compensation for 4 flights Aberdeen to Dalaman, 6th June 2013 - delayed over 3 hours on take off and arrival (FHY 642/641 - 19.55 departure time originally)
The flight carrier was actually Freebird - Turkish airline but my payment/contract is with Thomas Cook

Please advise how you came to this decision to enable my Lawyer to proceed with court action
