10 Day Hold for a Deposit? -- *HELP!*

I have a check for over $3100 and WF wants to put a 10 DAY HOLD on it because I'm overdrawn. This is the stupidest thing I've ever heard. I've trying to fix the overdrawn issue by depositing funds and they're making it worse by holding my money for as long as they can. Meanwhile, they're dinging me $5 a day and $35 for any automatic debits.

This is a payroll check from a large corporation that I've been receiving checks from for over 8 months. The people at the bank are completely unhelpful. I spoke to three of them all they said was the "system" won't let do anything to help me.

I really can't wait 10 days for this money and the fees that WF are charging daily because I'm overdrawn are making the problem worse and eating into what little money I have.

I don't understand why a bank like Wells Fargo is so insensitive and inflexible to it's customers.

What can I do about this? Someone PLEASE help!

  • I'm not sure of WF's specific policies, but this may be a possible method to expedite the availability of your funds. First, call the bank that the check is written from (the paying bank). Find someone who can verify for you that there are funds in the paying account to cover the check you are trying to deposit. Make sure to record this person's name and direct phone number. Call up your bank, i would recommend your local branch, and ask to speak with a manager. Give them the contact info of the person from the paying bank and tell them that this person will verify the funds for the check and then your bank should have no further reason to hold the funds.

  • I think that Wells Fargo acts illegally in this regard, and I would love to participate in a class action lawsuit. My girlfriend and I have been members of Wells Fargo for about 5 years. They refused to cash a $100 check because I only had $2 in my account. It's a load of crap.

    Wells Fargo frequently bend the rules in order to maximize the fees that they can charge.

    • I have a Wells Fargo acct. and really is the last of all the other shady bank. to bad I'm not wealthy enough to join a credit union where you area human being too them. I get harassed vehemently by Wells toupgrade, different accounts, you name it. got to the point I avoid actually going inside as much as possible soi stick to atm unlessi have to go in.   • File a complaint with the better business bureau. Your best bet is to close your account and find a better bank. Good luck! Banking consolidation has allowed monopolistic practices like these to flourish. WF knows Bank of America and Citi will bend you over too. You could try a breach of contract action, but for the most part the banks own the legal system. You would need to argue that the terms of the contract are a form of adhesion (in other words, you had no bargaining power in forming the contract and no real alternatives). WF will beat you on this lawsuit, but you might gain the satisfaction of running up some legal bills for them. If you really want to try to scare them, go for a class action lawsuit. Unfortunately, your beloved congressional hos passed a law during the Bush administration called the "Class Action Fairness Act". Guess what it does? That's right it makes it fairer for the poor corporate defendants to defend themselves from greedy plaintiffs who claim the corporation has been f'ing them. Pay your fees and be a good wage slave!

  • Well, as far as the first $100 goes, you should have been given the entire amount immediately, since you're not a new customer, unless there was a very good reason not to (check previously returned unpaid, frequent overdrafts, etc). And as to the main topic, though, they can and will place holds if you've had a history of overdrafts (to protect them against fraud). And these holds can be longer than the customary 5 day hold period, and you don't have to even be provided with the first $100.

  • Sofia, make sure you speak to someone at the bank, not a teller, hopefully they have someone who has received an award or seems to care about such issues, preferably a woman with a child, or a caring gentleman and request assistance with reversing those fees and most certainly check into another bank, most of them are pretty bad these days and getting worse.     I know this problem and therefore figure other means to cash those checks like go to their bank instead of mine because if you are unlucky with a corporation who does not have enough funds for all employees to cash their checks...your bank will charge you for their lack of funds. I recall when they use to show a pending on that amount by a certain date and then I will use it via debit before it becomes avail and wells fargo would not charge me, but times have changed indeed. sorry for your frustration

  • The simple solution here is 1) if ur gonna deposit a check that is not drawn off wells fargo make sure u have those fund available, checking or savings, or checking plus savings = the total, 2) make sure u dont overdraft, manage ur money correctly, online banking is there to help, u can transfer funds and they are available at that exact moment, if u know u have $3000 in ur account and go write a check for 3000.01 and it bounces, thats ur fault not the banks, yes u will be charged overdraft, yes the bank will take that into account when they go to deposit ur check, they want to collect the funds from the other bank first before they deposit it into your account, it is not the banks fault u can not manage ur money, it is yours! So yes holds are placed on accounts, if ur avg balance is $500 what sense does it make to say " ahh yes this check for $5000.00 is good im sure!" None! Also if u want to have the funds available asap, go to the bank the check is drawn off of and cash it there, besides what most people think u do not have to have an account with a bank to cash a check, stop being lazy and just drive to the other bank, either that or suck it up and wait the regular, extended or extended next day hold period.
    Cash deposits are available that the moment they are deposited, checks if there is not a hold placed on them and cause u know how to manage ur money are available next day, this mean if u deposit a check before the banks cut off time say tuesday at 1pm they will be available wed, preferably at opening of business, but if u deposit after cut off time which where i live is 3pm it would be thursday morning, cause work has to be shipped off and worked through the system its not that difficult.
    90% of banking problems are customers retardedness, banks have been running this way for decades, ask questions when u open an account if ur confused. Have funds in ur account, dont spend more than u have, check ur online banking daily, use a debit card (cause it shows up online as pending instantly, and subtracts that total from ur balance online) and quit writing checks cause depending on when the business takes them to the bank could take days to post. Finally if u have $30 in ur account, i myself am not gonna make that check for $5000 available next day, yes im gonna place a hold on it so that the bank can collect the funds first, so i can make sure ur not trying to scam me or the bank and put my job at risk cause u can not manage money well! If its drawn off my bank the by all means, if the funds are available in the account the checks from....ding ding ding money tommorrow!

  • Well for one if you knew anything about banking you would know that banks are not gonna just cash a $7000.00 check for you if you do not have the funds to back it up. Fraud is the #1 crime now, this includes, id theft, counterfeit money, and yes counterfeit checks that yes a good fake check will process through a banks system, so me calling to verify the funds, whos to say that is not one of your buds or family on the other line saying "Sure the checks great" when you have been running a fraud check system for years! So no theres not a bank i know that would just hand you 7000 dollars if you dont have the cash in an account to back it up, so no you are the one that should learn some stuff about banking, and yes i do work for a bank have for years. So get off my balls brah and learn banking 101 its not hard!

  • Your whole reply is full of fail, who goes to walmart to cash checks first off, your use of foul language shows you are very uneducated, using you moms bank shows you have no sense of worth or are still living under her roof, there is always exceptions to the rules, government checks is an example, most tax refund check are also, so sure some checks u could just walk in and cash, but this was not the original topic, the person stated they where overdrawn, went to cash a check that was a nice amount, and the bank wanted to hold the check, thats their right, they want to make sure they get their money first before they just say to someone whos gone in the negative "sure here you go, dont worry about the fact that you now owe us money!" The they tell you that your money will be available the next day "IS A LIE' statement is also not true, there are multiple different types of holds, next day, 3 day, 7 day, 10 day, even some that are longer, its to the banks discretion what type a hold, if they want to place a hold. There are banks that are more lean on those rules, banks that are big chains "Wells Fargo" for one who are not, probably why they are the nations 4th biggest bank now based on assests $1,223,630,000 worth to be exact and they do very well, because of the systems and rules they have in place! So please if you would like to contribute, dont curse people out for explaining why banks do the things they do, get a better education so that your grammar can be more expanded to words that are not so explicit, dont go to walmart to cash your check like a trailer park trash person would do, and last dont keep your money under your mattress its not safe there!

  • Hey goliath51989 -- you should read the original message more clearly before replying so quickly (and rudely) next time. This issue is now many months old -- but back then what I was trying to do was deposit a check and have it cover the overdrawn amount without continuing to accrue overdraft fees. Basically, I wanted the deposit to be recognized but Wells Fargo said they would continue charging a daily overdraft fee for the next 10 days and if any checks were presented during the 10 days they would bounce it. This is craziness because any other check would be put into "pending" status.

    I don't care what you or anyone says I think that is just wrong. I wasn't asking for one red cent of that money but I did want them to accept the money and stop charging me overdraft fees AFTER I had deposited more than enough money to cover the overdraft.

    I've since left Wells Fargo for Chase and never been happier. They don't do drama and would never pull crap like this.

  • WE had a somewhat similar issue happen to us. Someone pinged our acct illegaly we called wF to report the situation. Since it took them 5 business days to investigate the issue and not put a hold on that amt immediately and I paid pills prior to that illegal transaction it caused our acct to be overdrawn. Since it was a new acct they closed our acct and holding our funds for 10 business days which in the meantime our payroll cks went in as we were NEVER notified of them closing the acct. So now we have NO money but abt 25 dollars to live on until 2/10 when the acct will officially be closed, the ck will be mailed on 2/11 and that could take another 10 business days to come to us.
    Had they of done their job to begin with this never would have happened.

  • Customers should read the terms and conditions for the accounts they open. Educate yourselves about bank policies and regulations, maybe then you'll stop blaming Wells Fargo for your lack of financial responsibility ( I know these are hard times, but anyone who overdraws their account and has the NERVE to complain about the consequences, obviously has no shame. It's thanks to customers like these that banks have had to toughen their policies and regulations, otherwise, they'd be just as broke as the customers who have breached trust and continued to overdraw their accounts. Comon, kids, get with the program. And don't blame the tellers or personal bankers for these kind of situations because these "young and inexperienced kids" know the ins and outs of bank poilicies and procedures and Im willing to bet they wouldn't blame the bank for being in siimilar financial situations. Just saying.

  • Btw, Im sure Chase would love to pull the same "drama". All banks adhere to the same laws, therfore have very similar policies, you just haven't tried Chase yet. You probably havent had this type of experience with Chase because obviously you learned to be a better customer since WF treated you so "unfairly". I dare you to do the same thing again. Dare you. You'll probably be back here complaining about how Chase screwed you over. What about YOUR lack of financial responsibility? Is it fair that WF had to pay your original overdraft amount? Maybe tue situation would have been as bad if you had set up overdraft protection through a WF credit card or line of credit? Yeah, blame it on the bank.

    I have the same ten day hold, My account is overdrawn because they honored a post-dated check four days early, Overdrew my account and hit me with the silly $35 charge, now a check clearing that I had funds for overdraws and I'm hit with another $35! I go to the branch to maybe get relief.... nope. Even though I can't deposit post-dated check they can sure as heck honor them against my account to rack you nearly a tank full of gas funds. The branch lady calls somebody cause she thought a post-dated check was not deposit-able at her branch to find out and I quote "there is nothing we can do for you" Now I deposit funds to cover the checks and fees to find a ten day hold for get this "our risk models indicate that the following check may be returned" This is the same account I've been depositing checks from for over two years!!! Wachovia and before that Southtrust and even BTNB worked with the customer when it was even marginal error on their part. So my lesson learned, check date means NOTHING.

  • The person that you wrote the post dated check to should have not deposited it into their bank until the agreed upon date. That was an agreement between the two of you not an agreement between you and the bank. The bottom line here and if everyone would just get this through their heads : don't spend money via check or debit card that you don't have! I know its a tough concept to understand but i promise u if u follow that advise you won't have problems with the big bad banks "screwing you over"

  • I disagree, my understanding is, a check is a legal document to be honored as written. They are precise on the amount and the signature, but the date is meaningless? But stay tuned, later this month I'm going to attempt to deposit a post dated check, and when I'm turned away the fun begins.

People are just now finding my page and we would like to start a crusade against Wells Fargo and how they treat their customers. Please visit my facebook page and tell your story. WFDS (Wells Fargo Dealer Services) constantly harasses customers (I was a manager there) and does plenty of other things that just aren't right.
